In this Notice, “FME’’, ‘’We’’, ‘’Us’’ and ‘’Our’’ refers to companies affiliated with Fresenius Medical Care AG.
At the time of first registration with the Fresenius Medical Care Career Site (“FME Career Site”), you accept and agree to these Terms of Use. If you do not want to agree to these Terms of Use, please do not access or use this Site. FME Career Site is continually updated to provide you with recruitment and related services in order to help us manage our recruitment processes efficiently (collectively “Services”).
We use reasonable efforts to provide lawful and proper Services. Nevertheless, we assume no liability for the accuracy or completeness of the information provided to the user through or the uninterrupted access to the FME Career Site.
To the fullest extent permitted under applicable law, the FME Career Site and all of its contents, materials, information and Services are provided on an “as is” and “as available” basis, with no warranties or representations of any kind, express or implied.
We also cannot and do not guarantee that the FME Career Site or files available for downloading from this Site will be free of viruses or other destructive code. Users are responsible for implementing sufficient procedures and checkpoints to satisfy their particular requirements for anti-virus protection.
However, some jurisdictions do not allow certain limitations on liabilities in some circumstances, so some of the foregoing limitations may not apply to you.
If you continuously reside outside the United States of America, our liability for damages that may arise from your use of the FME Career Site is limited to gross negligence and intent. Notwithstanding the foregoing, we shall be liable for any negligent breach of essential obligations, the violation of which endangers attainment of the contractual purpose, or for the violation of obligations, the fulfilment of which is crucial for the proper execution of this type of contract or upon the compliance with which you can regularly trust on. In this case, we shall only be liable for the foreseeable damage typical for the Services in this type of contract. The aforementioned limitations of liability shall not apply in the event of injury to life, body and health. Insofar as the liability of us is excluded or limited, this shall also apply to the personal liability of our employees, representatives and vicarious agents.
The content on the FME Career Site’ (“Content”) is intended for information purposes, only. It does not provide, and is not a substitute for, professional employment, legal, medical or other specialist advice. We are not responsible for the content of third-party texts published on the FME Career Site. You acknowledge that the use of the FME Career Site is at your own risk.
We are the owner of all proprietor rights attached to FME Career Site, including its Content, design, tools and any other features. All texts and illustrations are covered by copyright. When using the Services, we grant the user a limited, non-exclusive, non-transferable, temporary, and revocable license to access FME Career Site its Content. Except for the foregoing limited license, no right, title, or interest shall be transferred to the user. The use of the FME Career Site shall be permitted solely for the user’s own personal purposes; any reproduction or passing on to third parties of Content shall be excluded. Any further use, in particular for commercial purposes, shall not be permitted. No rights or licenses other than expressly set out in these Terms of Use of any kind with respect to trademarks, copyrights, patents, etc. shall be granted to the user.
Every user shall only create one account on the FME Career site. You shall not create a new account if you have one already.
A user who is in violation of these Terms of use or applicable laws in the use of the FME Career Site, may be excluded from the further application procedure, and may be stopped from further using the FME Career Site.
We may amend these Terms from time to time in our discretion - for example, to reflect changes to applicable law and/or regulation, changes to market practices and/or technology, or changes to our business.
All changes are effective immediately when we post them to the FME Career Site or provide individual notice to users, unless a different time period is required based on applicable law.
Your continued use of this FME Career Site following the posting of any updates or changes to these Terms of Use constitutes your acceptance of such changes. If the user does not agree with such changes, the user must discontinue the use of the FME Career Site. The latest version of these Terms of Use is available at https://jobs.freseniusmedicalcare.com/terms-of-use.
The user may discontinue the use of FME Career Site at any time. FME may discontinue or temporarily suspend the provisioning of the FME Career Site at any time. FME may limit or stop the use of FME Career Site by the user, either permanently or temporarily, if the User violates these Terms of Use or applicable laws.
Any legal claims or lawsuits that may arise in conjunction with the use of the FME Career Site outside of the United States are subject to the interpretation of the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods, provided that this this stipulation is not in conflict with mandatory rules of the state in which you habitually reside. Nothing in these Terms of Use shall affect your rights as a consumer to rely on mandatory provisions of applicable local laws.
Any legal claims or lawsuits that may arise in conjunction with the use of the FME Career Site inside of the United States shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts without giving effect to any choice or conflict of law provision. Any legal suit, action, or proceeding by Users in the United States against the Company arising out of, or related to, these Terms of Use or this Site shall be instituted exclusively in the applicable federal courts of the United States or the courts of the Commonwealth of Massachusetts. Notwithstanding the above, we retain the right to bring any suit, action, or proceeding against you for breach of these Terms of Use in your state, province and/or country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction and venue over you by such courts.
We offer links to third-party content in addition to FME Career Site Content. The content and design of third-parties are beyond our control. We do not ensure nor control that the information provided by third-parties is accurate or correct. The links also represent no endorsement, support or confirmation of the contents at the linked sites. The individual authors of the linked content are responsible for the information, opinions and facts presented on their web pages. We are likewise not responsible for the technical security of both the content and any target pages.
